Environment, environmental permit or notification

You are starting a new business. You are making changes to your existing business or expanding it. In that case, you may need an environmental permit.

Requests

1. You can use the permit check tool on the Omgevingsloket website to see if you need an environmental permit. In addition, the Midden- en West-Brabant Environmental Agency (OMWB) provides a handy guide that explains in simple terms how you can quickly submit a notification to the municipality.
2. If the activities involved are complex (construction or renovation), you may need to obtain an environmental permit and also file a notification.
3. If you need a permit or are required to file a report, you can also apply for it online through the Omgevingsloket. For businesses, this can now only be done via “eHerkenning”; please visit the eHerkenning website for more information.
4. You will receive a written response from the competent authority. This may be the municipality, but it could also be the province, the water board, or the national government;
5. In most cases, consultation with the competent authority is required: an environmental permit requires a customized approach;
6. If your application is approved, the permit will be sent to you (along with the conditions under which the permit is granted);
7. If you disagree with the decision, you may file an appeal. The decision explains how to file an appeal.

Procedure

The preparatory procedure may be either standard or extended (depending on the complexity of the application). The standard preparatory procedure has a processing time of eight weeks (from confirmation of the application to the announcement of the decision) and may be extended by six weeks. The expanded preparatory procedure has a processing time of six months, with a possible extension of six weeks. The competent authority will indicate in advance which of the two types of procedures will apply.

Bring along

The modules and/or the competent authority will specify what information you must provide. This includes, for example:

• Your name and address;
• The business address;
• The cadastral designation;
• The company's location (using clear floor plans);
• The nature of the business;
• Certificate of Registration with the Chamber of Commerce.

Costs

Under the Environment Act, environmental fees are once again required. The amount depends on the type and number of activities. You can find this information in the Moerdijk Municipal Fee Ordinance.
